Terms of Service

Effective Date: August 20, 2026

Privacy PolicyPricingSubscription terms

These Terms of Service (“Terms”) govern your access to and use of Toque Play, the website at toque-play.com, the player app at app.toque-play.com, and related services (together, the “Service”). Toque Play (“we,” “us,” or “our”) provides a browser-based practice app for capoeira rhythms on a real physical berimbau.

Please also read our Privacy Policy at toque-play.com/privacy-policy, which explains how we collect and use information. A free plan is available. Paid weekly, monthly, and yearly plans are billed by Stripe; see the Subscription terms at toque-play.com/subscription-terms.

By creating an account, signing in (including with Google or Facebook), or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Toque Play helps you practice berimbau toques with live pitch detection and a scrolling note track. Microphone capture and pitch detection run in your browser on your device. We do not stream raw microphone audio to our servers. The server receives structured events (for example note identity, hit or miss, timestamps, and related scores) and other account data described in the Privacy Policy.

The Service is provided as a practice tool. Detection quality depends on your instrument, room, microphone, calibration, and how you play. We do not guarantee that every strike will be scored as a hit, or that the Service is suitable for professional assessment, exams, or live performance.

Features, rhythms, instruments, and availability may change as we improve the product. We may add, modify, or remove parts of the Service.

Some features require a paid subscription: every exercise after the first one in each rhythm, and more than one instrument. Checkout is in the player app (app.toque-play.com). Billing, auto-renewal, cancellation, and refunds are described in the Subscription terms.

2. Accounts and sign-in

You may register with email and password or sign in with a supported third-party provider (currently Google and Facebook). You are responsible for the accuracy of the information you provide and for keeping your credentials and devices secure.

If you use Facebook or Google, those providers’ terms and privacy policies also apply to their services. We receive identifiers and profile details they share with your authorization, as described in the Privacy Policy.

You must be at least 13 years old (or the minimum age required in your country) to use the Service. The Service is not directed to children under that age.

You may delete your account in the app (Profile) where that flow is available, or by contacting us. If you signed in with Facebook, you may also request deletion from Facebook (Settings → Apps and Websites). Facebook-only accounts are deleted; if Facebook is linked alongside email/password or Google, we remove Facebook login data and keep the rest of the account. See the Privacy Policy for details.

3. Acceptable use

You agree not to:

  • Use the Service for anything unlawful, harassing, or that infringes others’ rights.
  • Attempt to break into, disrupt, overload, or reverse-engineer the Service except as allowed by applicable law.
  • Circumvent scoring, progression, or access controls, or impersonate another person.
  • Upload malware, scrape the Service in a way that harms operations, or use automated means to create accounts or submit forms without our permission.
  • Misuse contact or feedback forms (spam, threats, or unrelated advertising).

We may suspend or terminate access if we reasonably believe these Terms have been violated, or to protect the Service, other users, or our legal obligations.

4. Intellectual property

The Service — including software, design, text, graphics, toque patterns we publish, and the Toque Play name and branding — is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial practice, subject to these Terms.

You retain rights in your own playing and in content you submit (for example feedback or contact messages). You grant us a license to use that submitted content as needed to operate, support, and improve the Service.

Capoeira rhythms and cultural traditions are not claimed as our exclusive property. Our practice patterns, UI, and software remain ours. Do not copy, redistribute, or commercially exploit the Service or our pattern files except as we expressly allow.

5. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PITCH DETECTION WILL MEET A PARTICULAR ACCURACY.

You are responsible for your physical practice (hearing protection, instrument setup, and playing safely). The Service is not medical, educational-accreditation, or professional instruction.

6. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE WERE ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO TEN EUROS (€10).

Some jurisdictions do not allow certain limitations. In those places, our liability is limited to the maximum extent permitted. These Terms do not limit liability that cannot be limited under applicable law (for example death or personal injury caused by negligence, or fraud, where such a limit is forbidden).

7. Termination

You may stop using the Service at any time and may delete your account as described above. We may suspend or end the Service or your access, with or without notice, if we discontinue the product, must comply with law, or reasonably believe you have breached these Terms.

Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) survive termination.

8. Changes to these Terms

We may update these Terms from time to time. The Effective Date at the top will change when we do. Continued use after the updated Terms are posted constitutes acceptance, except where applicable law requires a different process. If you do not agree to the updated Terms, stop using the Service and delete your account.

9. Governing law

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules, except that mandatory consumer protection laws of your country of residence continue to apply and cannot be waived by this clause.

If a dispute arises, contact us first so we can try to resolve it informally. Courts competent under applicable law may hear disputes; nothing here limits your right to bring a claim in the courts of your country of residence where consumer law requires that.

This clause may be updated if our operating entity or counsel later designates a different governing law or forum.
